Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by gigr (Instant Work) Ltd and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to gigr (Instant Work) Ltd and accessing the Website in connection with the provision of such services.

You must be at least 16 years of age to use this Website. By using the Website and agreeing to these terms and conditions, you represent and warrant that you are at least 16 years of age.

You agree to:

  • use your real name on your profile;

  • use the services in a professional manner.

You agree that you will not:

  • act in an unlawful or unprofessional manner including being dishonest, abusive or discriminatory;

  • misrepresent your identity, your current or previous positions, qualifications or affiliations with a person or entity;

  • disclose information that you do not have the consent to disclose;

  • create or operate a pyramid scheme, fraud or other similar practice.

Scraping or replicating any part of the platform without our consent is prohibited. This includes by any means (automated or otherwise) other than through our currently available, published interfaces - unless you have been specifically allowed to do so in a separate agreement with us.

When completing your profile, you agree to provide information that is both truthful and accurate, to the best of your knowledge. Not doing so causes bad feeling amongst users and can lead to users receiving negative reviews, which in turn significantly reduces chances of success on the platform. Repeat offenders will have their accounts deleted.

You can report any abuse or complain about User Content by contacting us via info@gigr.com, outlining the abuse and/or complaint.

    Intellectual property and acceptable use

  1. All Content included on the Website, unless uploaded by Users, is the property of gigr (Instant Work) Ltd, our affiliates or other relevant third parties. In these Terms and Conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner's prior written permission.

  2. You may, for your own personal, non-commercial use only, do the following:

    1. On creating a profile and registering personal details, users are agreeing to the sharing of those details with other users with whom they engage. For example, if you apply for a job, an employer is able to reveal your contact details and full profile.

  14. When you register on gigr, you will be asked to create a password, which you should keep confidential and not disclose or share with anyone.

  15. If we have reason to believe that there is or is likely to be any misuse of the Website or breach of security, we may require you to change your password or suspend your account.

Whilst gigr (Instant Work) Ltd uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, we give no warranty or guaranty in that regard and all Users take responsibility for their own security, that of their personal details and their computers.

  34. These terms and conditions may be varied by us from time to time. Such revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version. Users’ continued use of the platform will indicate their agreement to the new Terms.

  35. These terms and conditions together with the Privacy Policy and Cookies Policy contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.

  36. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and conditions and no third party will have any right to enforce or rely on any provision of these terms and conditions.

  38. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.

  39. This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.

  40. Payment of Fees

  41. If you have opted to pay a monthly subscription to gigr (Instant Work) Ltd, you agree to do so on time.

  42. As a User who is seeking staff for their business, monthly subscription packages do not allow unused REVEALS to carry over to the following month. Unused REVEALS are deleted from your Dashboard/account at the end of your month’s subscription.

  43. Failure to make a subscription payment within 7 days of the due date will lead us to assume that you are moving to a Pay As You Go plan, whereby you pay a one-off fee for each Reveal of a gigr’s contact details you conduct. It is understood that the unit cost via PAYG is greater than that of a subscription plan. Further details of these fees are available on the website.

  44. Payment processing fees, as outlined by our secure payment provider, Stripe, will be covered by us, gigr (Instant Work) Ltd, and are included in User fees (PAYG and Subscription Plans).

  45. If you choose not to pay a monthly subscription, you agree to pay for each Reveal on a Pay as You Go basis. For an overview of costs and fees, go to www.gigr.com.

  46. Users can cancel monthly subscription packages at any time. Any unused REVEALS will be available until the end of the month in which the subscription is cancelled but will be deleted at midnight on the last day of that month.

  47. gigr (Instant Work) Ltd reserves the right to amend Price Cards (fees charged) at any time but will inform Users via updates on the website and by email.

  48. Bad Practice, Disputes and Resolutions.

  49. Good and positive practice on gigr.com is encouraged and supported at every opportunity, but we recognize that disputes may arise between Users. The following are examples of bad practice, although this list is by no means exhaustive: Receiving 3 low ratings (2 stars or less) in a row, regularly withdrawing from jobs you have accepted, or regularly cancelling jobs you have posted.

  50. User practice is monitored carefully so that bad practice is filtered out. Users can contact us via resolutions@gigr.com and receive support should they have issues with other users.

  51. Reported incidents/disputes are each considered on an individual basis and any decision made or action taken by the Resolution Team is full and final.

  52. While we aim to resolve disputes amicably and encourage users to resolve them between themselves, persistent bad practice by Users could ultimately lead to them being blocked from the site.
